Terms of Service
These Terms of Service ("Terms") govern your family's use of the 30 a Day coaching service ("Service"), operated by Cory Needham doing business as 30 a Day ("we," "us," or "our"). By enrolling a student in the Service and completing the online parental consent form, the parent or guardian agrees to these Terms.
1. Description of Service
We provide math accountability coaching to students in grades 4 through 12. The Service combines access to the Math Academy adaptive learning platform with regular text-message check-ins from a human coach, weekly video coaching sessions, and parent progress communications. We do not provide math instruction directly; the platform provides the curriculum and instruction. The coach's role is accountability, motivation, parent communication, and adjustment when needed.
2. Enrollment and Eligibility
Enrollment requires a parent or guardian to (a) complete the online consent and enrollment form, (b) provide accurate contact information for the student and themselves, and (c) confirm that the student is at least 12 years old at the time of enrollment. For students under 12, additional COPPA-compliance requirements apply; please contact us to discuss.
3. Family Obligations
Continued participation in the Service requires that the student maintain a minimum level of engagement, as defined in the family's individual service agreement. This typically includes 100 minutes per week of Math Academy practice across at least four separate days, attendance at the scheduled weekly coaching session, and timely parent acknowledgment of progress updates.
4. SMS Communications
Enrollment in the Service includes SMS (text) message communication with the assigned coach, as fully described on our SMS Program Disclosure page. By completing the online parental consent form, you authorize 30 a Day to send SMS messages to the student and parent phone numbers you provide.
You may opt out of SMS at any time by replying STOP to any message. Replying HELP will produce a response from a real person. Standard messaging and data rates from your wireless carrier may apply.
5. Fees and Payment
Pricing depends on your family's enrollment tier. Some students are enrolled at no cost during our pilot program. Tier-specific pricing is communicated in writing in the family service agreement before any fees are charged.
6. Cancellation
You may discontinue participation in the Service at any time by providing written notice (email is acceptable) to hello@30aday.ai. Any prepaid fees for the current billing period are non-refundable, but no further fees will be charged after notice is received.
7. Mandated Reporting
Our staff includes credentialed educators who are mandated reporters under California law. If, in the course of operating the Service, we receive information that gives us reasonable suspicion that a student is being abused, neglected, or is at risk of self-harm, we are required by law to report this to the appropriate authorities. This obligation supersedes any expectation of confidentiality.
8. No Guarantee of Specific Educational Outcomes (Except as Stated)
Educational outcomes depend on many factors including student effort, prior preparation, learning differences, and external circumstances. We do not guarantee specific test scores, grade improvements, or educational placements. Where we offer a results guarantee in connection with a specific course of coaching, the terms of that guarantee are set out separately in writing and require that the family meet defined effort obligations.
9. Intellectual Property
Math Academy platform content is the property of Math Academy and is used by enrolled families under Math Academy's own terms of service. Custom materials, coach notes, and progress reports produced by 30 a Day are our property, but enrolled families may use them freely for their student's educational benefit.
10. Limitation of Liability
To the maximum extent permitted by California law, 30 a Day's total liability under these Terms in any twelve-month period is limited to the total fees paid by the family during that period. We are not liable for any indirect, consequential, or incidental damages. We are not liable for outages or interruptions in the Math Academy platform, the Twilio messaging network, or any other third-party service that the Service depends on.
11. Indemnification
The parent or guardian agrees to indemnify and hold harmless 30 a Day from any claim arising out of (a) misrepresentation of the student's age or eligibility, (b) misuse of the Service or its communications, or (c) breach of these Terms.
12. Modification of Terms
We may update these Terms from time to time. Material changes will be communicated to enrolled families directly. Continued participation in the Service after a change indicates acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Sonoma County, California.
